This policy is for B.K BROKERS PTY LTD (“we,” “us,” “our”), who is considered an Australian Privacy Principles (APP) entity, as defined in the Privacy Amendment (Enhancing Privacy Protection) Act 2012.
This policy outlines, including but not limited to: who we are, the kinds of Personal Information (PI) we collect, how we collect and use PI, how we handle anonymity, unsolicited information, direct marketing, cross-border disclosures, government identifiers, accuracy and security of PI, your access and correction rights, complaint handling, and how to contact us.
We are finance brokers providing Credit Assistance when we suggest or assist you to apply for a credit contract, increase a credit limit, or remain in an existing contract with a credit provider. Customers engage us to arrange loans and insurance products tailored to their needs.
Personal Information (PI) is information about an identified individual or one who is reasonably identifiable. Examples include: name, address, contact details, date of birth, bank details, employment details, and credit history. Sensitive Information (e.g., health or criminal records) is generally not collected unless relevant to finance or insurance products, in which case your consent will be obtained.
We collect PI directly from you when you apply for finance or insurance. With your consent, we may also collect from third parties such as employers, accountants, banks, or referrers. This is considered solicited information.
We collect PI to provide requested finance or insurance products, in accordance with the Privacy (Credit Reporting) Code 2024 (CR Code). Information may be disclosed to financiers, insurers, credit reporting bodies, your employer or accountant, suppliers, and referees. PI is held for seven years after a finance contract ends, after which it is deleted if no longer required.
You may deal with us anonymously for general enquiries. However, identification is required for finance or insurance applications.
We only collect solicited information necessary for finance or insurance. Unsolicited PI will be assessed, and if not lawfully collectible or unnecessary, destroyed or de-identified.
When collecting PI, we will notify you of the purpose, disclosure, access/correction rights, and complaint procedures. If collected from third parties, we will inform you accordingly.
We may use your PI for marketing additional products or services via email, phone, SMS, social media, or mail. You can opt out at any time by contacting us, and we will update our records within 30 days.
PI may be shared with organisations overseas in countries including Germany, New Zealand, UK, Philippines, India, Singapore, Japan, Malaysia, Vietnam, and USA. While we take steps to protect PI, overseas organisations may be subject to local laws requiring disclosure.
We may collect identifiers such as Driver’s Licence, Passport, or Tax File Numbers as part of finance applications. These are only used where required by law or financier processes, and TFNs are de-identified as required under the Tax File Number Rule 2015.
We take steps to ensure PI is accurate, up to date, and secure. Measures include confidentiality agreements, secure storage, system security, restricted access, firewalls, and encryption. In case of a data breach, we will notify affected individuals as required by law.
You may request access to PI we hold about you, subject to exceptions (e.g., safety risks, legal proceedings, commercial confidentiality). If access is denied, reasons will be provided. You may also request corrections to ensure information is accurate and current.
